One-To-One Rewards Card – A Preferred Customer Program
TERMS AND CONDITIONS
The following document details the terms and conditions of Venice Nissan One-To-One Rewards Program.
Upon receipt of the membership card/key tags (the "Card"), member agrees to be bound by the program rules, terms and conditions. Venice Nissan One To One Rewards program members will receive incentive points for every dollar spent on parts and services and up to $250.00 on vehicle purchases. These points are only redeemable at Venice Nissan. This is at no cost to you. Simply swipe your card at our cashier office when you pick up your vehicle and we'll take care of the rest. With every dollar you spend in our service department we will apply 5% of your total bill to your member card in the form of award points. We are a full-service maintenance and repair center. As an authorized Nissan Dealer, our customers are assured of the availability of Genuine Nissan Parts for all vehicle maintenance and repair needs. Excludes: Collision repairs. No more than on card per customer, only one discount per transaction.
Venice Nissan One-To-One Rewards Program members will receive rewards points on purchases of parts, accessories and service purchased at our dealership.
OVERVIEW OF ONE-TO-ONE REWARDS PROGRAM
The Venice Nissan One-To-One Rewards Program is a loyalty program sponsored by Nissan North America and Venice Nissan that allows preferred customers to earn rewards points toward future service, parts and accessory purchases. Rewards points acquisitions include new and used vehicle purchases, service labor and parts/accessories purchases from Venice Nissan, up to a maximum of $300.00 in any one transaction. All earned rewards points can be used for retail purchases at Venice Nissan ONLY.
PROGRAM RULES
1. Rewards points cannot be redeemed for cash.
2. Any items purchased through the One-To-One Rewards Program cannot be returned for cash. All returned items’ value will be applied to the Rewards Card. No exceptions.
3. Rewards points issued by Venice Nissan do not expire.
4. Rewards Plus points earned by shopping online through www.nissanonetoonerewards.com will expire within 24 months.
5. Rewards points cannot be used in conjunction with other specials and coupons.
6. Your Rewards Card can be used for ANY vehicle in your household.
7. Rewards points can only be earned on cash purchases (i.e. customer pay service or vehicle sales) Qualified purchases include retail parts, detail, services, maintenance and accessories. Excludes collision repairs. Each of the points earned is equal to one dollar in awards discounts. You can not accrue points on new or used vehicle purchases, body shop services, wholesale parts purchases, warranty, insurance or extended warranty purchases.
8. Membership and Points may not be transferred from account to account. At no time can Members pool accumulated points to increase standings. Membership and points can not be sold, bartered, brokered or transferred for any reason including death and domestic matters. Membership and points have no cash value.
9. Earned rewards/points or discounts cannot be applied to prior purchases. Must present card at time of purchase. Earned points can only be redeemed at Venice Nissan.
EARNING PROGRAM DOLLARS
1. When you first enroll in the Program, the Preferred Owner(s) will receive a Venice Nissan One-To-One Rewards Card. The card is to be used for each eligible transaction.
2. There are two types of Rewards points – SALES and SERVICE. Rewards points can be earned in the following manners: a. Sales points - Vehicle purchase, New or Used (wholesale excluded) earns $250.00 toward a future vehicle purchase;
b. Service points - Each service event (parts and labor) earns 5% of total dollars spent (less tax and shop supply charges) towards a future vehicle, service, parts or accessory sale.
REDEEMING REWARDS (DOLLARS)
1. ‘Sales’ rewards points can only be redeemed towards a qualifying vehicle purchase. Please see dealer for qualifying vehicles.
2. ‘Service’ rewards points can be redeemed towards a vehicle purchase, customer-pay service visit, or parts or accessories order.
PARTICIPATION IN THE PROGRAM
The Program is available to all Venice Nissan customers who are over the age of 18.
The personal information that is collected from each customer in connection with the Nissan One To One Rewards program will be used in accordance with the Nissan Privacy Policy.
You hereby provide your express consent for Maritz to provide information relating to the One To One Rewards Program solely to Nissan North America (NNA). This information includes, but is not limited to: customer names, addresses, phone numbers, e-mail addresses, One To One Rewards Program account numbers, transactional detail, account balances and redemption information.
VENICE NISSAN ONE-TO-ONE REWARDS PROGRAM
Participation in the Program constitutes each Preferred Owner’s full and unconditional agreement to these Terms and Conditions.
The personal information that is collected from each customer in connection with the Program will be used in accordance with NISSAN Privacy Policy.
GENERAL TERMS AND CONDITIONS
Venice Nissan may modify any of the terms and conditions governing the Program - including, but not limited to, the methods through which rewards points can be earned, how the Program can be used, the value of the earned points, at any time, without notice, even though these changes may affect the Preferred Owner’s ability to use the points that have already been earned.
The Program has no pre-determined termination date and may continue until such time that Venice Nissan may terminate the program at any time, with no notice given.
Accrued rewards points do not constitute property of a Preferred Owner and have no value outside of the program. Rewards points are credits that Venice Nissan may revoke at any time as set forth herein. Rewards points may not be exchanged for cash, assigned, bartered or transferred except as matter or otherwise by operation of law.
Each Program member is responsible for ensuring that the information in his/her account is accurate and kept current.
These Terms and Conditions are governed by and interpreted under the laws of the State of Florida, US; as such laws are applied to agreements entered into and to be performed entirely within Florida by Florida residents. These Terms and Conditions and any documents it incorporates set forth the entire understanding between the parties with respect to the subject matter hereof.
Abuse of the One-To-One Rewards Program (including failure to follow program policies and procedures, the sale or barter of awards and any misrepresentation of fact relating thereto or other improper conduct, as determined by Dealer in its sole judgment, any untoward or harassing behavior with reference to any Dealer employee or any refusal to honor Dealer employee’s instructions) may result in cancelation of the member’s account and future disqualification from program participation, forfeiture of all points accrued. Dealer reserves the right to take appropriate legal action, as it deems necessary, and to recover damages, attorney’s fees and court costs.
Limitation of Liability governs that each Program member accepts all responsibility for and hereby indemnifies and holds harmless Venice Nissan, and each of their related companies (NISSAN) and respective officers, directors, employees, shareholders, agents and successors and assigns the Released Parties from and against any claims that may arise from actions taken by such Member or for any unauthorized access to Preferred Owner’s account from a third party. Under no circumstances, including but not limited to negligence, shall the Released Parties be liable for any direct, indirect, incidental, special or consequential damages arising out of the program. By participating in the Program, the Member waives any and all rights to bring any claim or action related to such matters in any forum beyond one (1) year after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based.
If any provision of these Terms and Conditions is found to be invalid or unenforceable by court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in force.
